1.1 These Terms and Conditions of Sale (“Sale Terms”) apply to all purchases made through www.pomi-t.co.uk (the “Site”).

1.3 Sales and Fulfillment Partner: While the Site is operated by Original Formula Ltd, all commercial transactions, order processing, and physical fulfillment are currently handled by our partner UAB Medgidas (Company Code: 304898313, Address: Polocko 17-212, 01205 Vilnius, Lithuania). When you place an order, your contract of sale is established with UAB Medgidas.
2. Applicability of These Terms
2.1 These Sale Terms govern the sale of products through the Site. 2.2 They apply in addition to our Terms of Use and Privacy Policy. 2.3 If there is any conflict between these Sale Terms and any other terms, these Sale Terms shall prevail in relation to purchases.
3. Products
3.1 Product Information: We take reasonable care to ensure that product descriptions, images, and information on the Site are accurate.

Packaging, labels, or minor details may vary.
All products sold are food supplements and are intended to be used as part of a varied and balanced diet and healthy lifestyle.
Usage: Standard daily intake is 2 capsules. Depending on individual requirements, this may be increased to a maximum of 4 capsules per day, as indicated on the product label. Do not exceed the maximum daily limit. 3.2 Availability: All products are subject to availability. Where a product is temporarily unavailable, it may be offered on backorder. 3.3 Pre-Orders: Certain products may be offered on a pre-order basis. Pre-order products are not immediately available for dispatch, and estimated dates are for guidance only.
4. Orders
4.1 Placing an Order: Your order constitutes an offer to purchase. A binding contract is formed only when we confirm acceptance. 4.2 Order Confirmation: Receipt of an order confirmation email confirms receipt but does not constitute acceptance. Acceptance occurs when payment is received or completed.
5. Pricing
5.1 Prices: All prices are shown in GBP (£) and include VAT where applicable. 5.2 Pricing Errors: In the event of a pricing error, we reserve the right to cancel the order and offer a refund or the correct price.
6. Payment
6.1 Payment Methods: We accept payment via the methods displayed at checkout. 6.2 Pay-Later and Backorder Orders: For certain situations, orders may be placed without immediate payment; a secure payment link will be sent when the order is ready for dispatch.
7. Delivery
7.1 Dispatch: Estimated dispatch times are guidance only. Orders are dispatched via FedEx Express from our European hub. 7.2 Delivery Addresses: Responsibility for providing correct delivery details rests with the customer. 7.3 UK and International Delivery (DDP): We operate on a Delivered Duty Paid (DDP) basis for all UK orders. This means that UAB Medgidas takes full responsibility for all import formalities, including UK VAT, customs duties, and brokerage fees. The total price displayed at checkout is the final price you pay; no additional fees will be charged upon delivery.
8. Risk and Title
8.1 Risk passes to you upon delivery. Ownership passes only once full payment has been received.
9. Right to Cancel (Consumer Rights)
9.1 Cooling-Off Period: UK/EU consumers have the right to cancel within 14 days of receiving goods. 9.2 Effects of Cancellation: You must return goods unused and in original condition; you are responsible for return shipping costs unless goods are faulty. 9.3 Exceptions: For hygiene and safety, we reserve the right to refuse returns of opened or used food supplements unless they are faulty.
10. Returns and Refunds
10.1 Details of our return process are provided on the Site. Statutory rights regarding faulty goods remain unaffected.
11. Limitation of Liability
11.1 To the fullest extent permitted by law, we do not exclude liability for death or personal injury caused by negligence or fraud. 11.2 We shall not be liable for losses resulting from misuse, indirect losses, or failure to follow usage instructions.
12. Force Majeure
12.1 We are not liable for delays due to events beyond our control, including supply chain disruptions or regulatory actions.
13. Governing Law and Jurisdiction
13.1 These Sale Terms are governed by the laws of England and Wales. Disputes may be brought before the courts of England and Wales or your country of residence where required.
14. Severability
14.1 If any provision is held unlawful, the remaining provisions remain in full force.
